Terms of Service

Last updated: August 11, 2026

1. Agreement to Terms; Order of Documents

These Terms of Service (these "Terms") are a legal agreement between you and Wayward Found LLC ("Wayward Found," "we," "us," or "our") and govern your access to and use of the Wayward Found website, web application, mobile applications, AI-assisted features, community-submission workflows, subscription features, and related services (collectively, the "Service"). By creating an account, clicking to accept, purchasing a subscription, or accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, you may not access or use the Service. You represent that you are using the Service for personal, devotional, and non-commercial purposes unless we have separately agreed otherwise in writing.

These Terms incorporate by reference our Privacy Policy, our Refund Policy, any product-level subscription disclosures shown at checkout, and any mobile application addendum that applies to an app-store-distributed version of the Service. If there is a conflict, the checkout disclosures govern the price, billing cadence, renewal date, and trial or promotional terms for the specific purchase; these Terms govern the legal relationship generally; and any app-store terms govern only where the applicable app store requires them to control.

2. The Service; U.S.-Only Launch

Wayward Found is an AI-powered Christian discipleship platform that provides tools for prayer generation, scripture study, journaling, spiritual reflection, an AI feature currently referred to as the "AI Spiritual Director," and community-submission features such as Stories of Grace.

The Service is currently intended for users located in the United States. We do not intentionally offer paid subscriptions to users in the United Kingdom, European Union, European Economic Area, Switzerland, or other non-U.S. jurisdictions at this time. We may restrict registration, access to paid features, subscription purchases, or other access where we determine that a user is located outside the United States. If you access the Service from outside the United States, you are responsible for complying with local law, and your access does not mean that Wayward Found is targeting, offering, or localizing the Service for your jurisdiction.

We may change, suspend, discontinue, or limit any feature of the Service at any time, subject to applicable law and any paid subscription rights expressly stated in these Terms.

3. Eligibility; User Accounts

You must be at least 18 years old to create an account, purchase a subscription, submit content, or use the Service. The Service is not intended for minors. By creating an account or using the Service, you represent that you are at least 18 years old.

You agree to provide accurate, current, and complete account information and to keep that information current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account, except to the extent caused by our failure to use commercially reasonable security measures.

Accounts are personal to a single individual. You may not share, transfer, sell, lend, sublicense, or otherwise make your account credentials available to another person, and you may not allow another person to access the Service through your account. Paid or premium features are licensed per individual user, not per credential.

We may use automated and manual review of login activity to detect account sharing, credential abuse, fraud, or security risks. Signals may include distinct devices, IP addresses, locations, or concurrent sessions associated with an account. We will handle this information as described in our Privacy Policy. Accounts that appear to be shared or misused may be suspended or terminated, and access to paid features may be revoked, subject to the Refund Policy and applicable law.

4. Subscriptions, Automatic Renewal, Payments, and Cancellation

This Section 4 applies when paid subscriptions are made available or purchased through the Service. If paid subscriptions are not yet available, the subscription, renewal, cancellation, trial, promotional-price, and price-change provisions below describe the terms and operational commitments that will apply when paid subscriptions are launched.

4.1 Paid subscriptions and Stripe payment processing. Certain features of the Service may require a paid subscription. For web subscriptions, Wayward Found is the merchant/seller of the subscription and uses Stripe as its third-party payment processor and billing platform. Stripe processes payments, payment credentials, invoices, receipts, customer billing-portal functions, tax calculation where configured, and related billing operations on our behalf. You may be required to accept Stripe's applicable terms or payment-method terms during checkout.

Stripe is not the merchant of record for web subscriptions unless we expressly implement and disclose a Stripe merchant-of-record product. Stripe's role as payment processor does not transfer Wayward Found's responsibilities for the Service, subscription disclosures, refunds, chargeback responses, sales-tax registration, collection, and remittance decisions, or user experience we control. Stripe's services are subject to Stripe's applicable terms and privacy disclosures.

4.2 Automatic-renewal offer terms. Before you complete a paid subscription purchase, the checkout flow will disclose the subscription plan, recurring price, applicable taxes or tax calculation where available, billing cadence, renewal period, any minimum purchase obligation, the date and amount of the first charge, the date and amount or method of calculating future recurring charges, any free-trial or promotional-price terms, and how to cancel. Current plan options may include weekly, monthly, and annual pricing, each as shown at checkout. Do not complete the purchase unless you understand and agree that the subscription will automatically renew until canceled.

By clicking the purchase, subscribe, start trial, or similar button and providing any required affirmative consent at checkout, you expressly authorize Wayward Found, through Stripe or another authorized payment processor, to charge your selected payment method on a recurring basis at the price and billing cadence shown at checkout until you cancel or the subscription is otherwise terminated. We and Stripe may retain records of your consent and the version of the automatic-renewal terms presented to you as required or permitted by law.

4.3 Retainable acknowledgment. After purchase, you will receive or have access to a confirmation, receipt, invoice, billing-portal record, or other acknowledgment from Wayward Found, Stripe, or another authorized payment platform that includes or links to the automatic-renewal terms, cancellation policy, and information on how to cancel in a form capable of being retained by you.

4.4 How to cancel. You may cancel your subscription at any time through your account settings (Settings → Subscription), through the Stripe customer portal or any cancellation link in your receipt, invoice, billing portal, or subscription-management flow, or by contacting support@waywardfound.com. If you subscribed online, you must be able to cancel online without being required to call, mail a letter, or engage in unnecessary steps that obstruct or delay cancellation. We may authenticate you before processing cancellation.

Cancellation takes effect at the end of your current billing period unless applicable law requires a different result. You will keep access to paid features until that date and will not be charged again unless you resubscribe.

4.5 Refunds. Except as stated in the Refund Policy or required by applicable law, we do not provide prorated refunds or credits for partial billing periods, unused time, or failure to use the Service. Wayward Found is responsible for refund decisions for web subscriptions, and approved refunds are processed through Stripe or another authorized payment platform, subject to the Refund Policy, card-network rules, payment-processor timing, and non-waivable consumer-protection laws.

4.6 Trials, promotional prices, annual renewals, and renewal reminders. If we offer a free trial, free-to-pay conversion, or promotional price, the checkout flow will disclose when the trial or promotional period ends, the price and billing cadence that will apply afterward, and how to cancel before charges begin or increase. Where required by law, we will send a reminder before the trial, promotional period, or annual subscription renews.

For annual subscriptions, we will provide renewal reminders and cancellation instructions in the timing and form required by applicable law.

4.7 Price changes and material changes. We may change subscription prices or material automatic-renewal terms for future billing periods. Where required by law, we will give clear and conspicuous advance notice of the change and information on how to cancel. For price increases, our operational target is to provide notice approximately 30 days before the change takes effect; in jurisdictions that prescribe a different window, we will follow the legally required timing. Where affirmative consent is required by applicable law, the price increase will not apply unless you provide that consent or unless another legally permitted process is followed.

4.8 App-store purchases. If you purchase through the Apple App Store, Google Play, or another app store rather than the web checkout, billing, cancellation, and refunds may be handled by that app store under its terms. In that case, you must use the app-store cancellation mechanism, and app-store refund rules may control to the extent required by the applicable platform.

5. Acceptable Use and AI Safety Rules

You agree not to use, attempt to use, or assist another person in using the Service to:

  • generate, upload, submit, publish, or distribute hateful, abusive, harassing, exploitative, threatening, defamatory, deceptive, discriminatory, sexually explicit, or unlawful content;
  • submit, generate, or solicit content that sexualizes, endangers, exploits, or targets minors, or that depicts minors in a sexual or exploitative context;
  • submit, generate, or solicit instructions for self-harm, suicide, abuse, violence, terrorism, illegal activity, or evasion of law enforcement;
  • misrepresent AI-generated content as divine revelation, prophecy, doctrine, authoritative pastoral counsel, licensed professional advice, or the personal voice or command of God;
  • attempt to manipulate, jailbreak, prompt-inject, reverse engineer, bypass safety systems, extract system prompts, obtain hidden instructions, or cause the Service to produce content it is designed to refuse;
  • use prompts, outputs, transcripts, summaries, tags, model behavior, or other Service content to train, fine-tune, evaluate, benchmark, validate, or build a competing AI model, dataset, product, or service, except to the extent this restriction is prohibited by applicable law;
  • access the Service through automated, scripted, scraped, or non-human means without our prior written consent;
  • impersonate any person or entity, including clergy, religious authorities, Wayward Found personnel, church leaders, reviewers, or other users;
  • harvest, scrape, collect, or process data from the Service or other users without authorization;
  • interfere with, disrupt, overload, probe, scan, compromise, or attack the Service or related infrastructure;
  • violate applicable law, third-party rights, scripture-translation licensing terms, or platform rules; or
  • use the Service or outputs for commercial resale, sublicensing, redistribution, or public-facing products without our prior written consent.

We may remove content, restrict features, suspend accounts, terminate accounts, or preserve and disclose information where we reasonably believe it is necessary to enforce these Terms, protect users or others, comply with law, or protect the Service.

6. Intellectual Property; AI Outputs; Scripture Text

The Service, including its software, code, design, interfaces, workflows, prompts, safety systems, models as configured by or for us, compilations, documentation, trademarks, branding, and other technology and content, is owned by Wayward Found or its licensors and is protected by intellectual-property and other laws. Except for the limited rights expressly granted in these Terms, we reserve all rights.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, devotional, non-commercial purposes during the term of your account.

AI-generated outputs produced for you through the Service may be used by you for personal, devotional, non-commercial purposes, subject to these Terms and third-party rights. AI outputs may be similar or identical for different users, may include public-domain or third-party content, and do not give you ownership of the Service, underlying models, prompts, safety systems, or any third-party content embedded in the output.

Scripture text included in outputs or shareable assets is governed by the licensing status and terms of the applicable translation. The Berean Standard Bible text is currently dedicated to the public domain by its publisher, but other translations may require attribution, impose quotation limits, prohibit commercial use, or require permission. You are responsible for ensuring that any translation you select or add is used consistently with its applicable terms.

7. User Content; Stories of Grace

"User Content" means any content you submit, upload, record, transmit, or make available through the Service, including prayers, journal entries, prompts, Spiritual Director conversations, stories, testimonies, audio, video, transcripts, comments, feedback, and materials submitted through Stories of Grace or similar workflows. You retain ownership of your original User Content, subject to the licenses and rights granted in these Terms.

You represent and warrant that you have all rights, permissions, and consents necessary to submit your User Content and to grant the licenses in these Terms, including rights from any person whose name, likeness, voice, personal story, church affiliation, testimony, music, images, or other protected material appears in audio or video submissions.

By submitting User Content, you grant Wayward Found a non-exclusive, worldwide, royalty-free license, sublicensable solely to our service providers, contractors, vendors, hosting providers, AI/transcription/moderation providers, authorized reviewers, and other persons acting on our behalf or at your direction, to host, store, reproduce, transcribe, translate, format, modify, create derivative works from, process with automated tools, moderate, review, display, publish, distribute, and otherwise use the User Content as reasonably necessary to provide, secure, improve, and operate the Service and the submission workflow you selected.

For Stories of Grace and similar community features, this license includes the right to transcribe audio or video, run content-safety and moderation checks, generate summaries, tags, reviewer notes, shareability assessments, pull-quotes, captions, scripture pairings, layouts, share cards, and other derivative or assistive assets. AI-generated suggestions are review aids and drafts; they are not an automated publication pipeline.

For Stories of Grace and similar community submissions, we will use commercially reasonable efforts to remove direct personal identifiers before public publication, except where you expressly approve publication in identifiable form or where the nature of the content, voice, image, video, context, church affiliation, or narrative details makes full anonymization impracticable. We do not guarantee that all submitted content can be fully anonymized or that people familiar with the underlying events will be unable to recognize the submission.

A human review step is required before a Story of Grace submission is publicly displayed through a Wayward Found-controlled public feature. We may decline, quarantine, edit, de-identify, or remove submissions in our discretion, including for safety, privacy, quality, theological, legal, or mission-fit reasons.

You may request removal of your User Content by contacting support@waywardfound.com. We will remove User Content from Wayward Found-controlled public pages within a reasonable time, subject to backups, legal compliance, security records, prior downloads or shares by others, app-store or platform requirements, and copies we are required or permitted to retain. Removal of source User Content will also apply prospectively to transcripts, summaries, tags, share-card suggestions, and other derivatives tied to that source content under our control.

Submitting feedback or suggestions about the Service grants us a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without restriction or compensation.

8. AI Processing; Human Review; Third-Party Providers

The Service uses AI and other automated tools to generate devotional content, assist with scripture study, support journaling and reflection, moderate content, transcribe audio and video, summarize submissions, tag content, and suggest shareable derivative assets. We may use third-party service providers, including OpenAI, Amazon Transcribe, AWS, and similar providers, to provide these functions.

Where AI is used to process Stories of Grace or similar public-submission content, AI outputs may be surfaced to authorized reviewers to assist review, moderation, and publication decisions. A human reviewer must approve public publication through Wayward Found-controlled public features.

The Service may use automated safety filters or moderation tools to identify content that appears to violate these Terms or suggests crisis, abuse, self-harm, or other safety risks. Those tools are imperfect and do not create a duty to monitor all content or guarantee detection, intervention, escalation, or prevention of harm.

9. Privacy; No Legal Privilege

Our Privacy Policy describes how we collect, use, disclose, retain, and protect personal information. The Service may involve deeply personal spiritual, religious, emotional, and journal content. We treat that content as sensitive within our operational controls, but the Service is not a church, clergy relationship, therapist, doctor, lawyer, crisis counselor, or legally privileged communications channel. Communications with the Service are not clergy-penitent, attorney-client, psychotherapist-patient, medical, or other privileged communications unless a separate mandatory law independently provides such protection.

10. AI-Generated Content; Disclaimers; Crisis Resources

10.1 AI output is a devotional aid only. AI-generated content is produced by artificial intelligence and is intended only as a devotional, educational, and reflective aid. It may be inaccurate, incomplete, misleading, repetitive, emotionally inappropriate, theologically unsound, or unsuitable for your circumstances. It does not represent divine revelation, prophecy, doctrine, the voice of God, a command from God, or an authoritative interpretation of Scripture.

10.2 Not pastoral, professional, medical, mental-health, emergency, legal, or financial advice. The Service, including the AI Spiritual Director feature, is not a pastor, priest, spiritual director, therapist, counselor, psychologist, physician, lawyer, financial advisor, emergency responder, or crisis service. The feature name "AI Spiritual Director" is a product label only. Outputs are not a substitute for personal Bible study, prayer, gathered worship, accountability in a local church, qualified pastoral counsel, licensed professional advice, or emergency assistance.

You are responsible for evaluating outputs against Scripture, sound Christian teaching, qualified human counsel, and your own circumstances. Do not rely on the Service as the sole source of truth or as the basis for serious personal, spiritual, medical, psychological, legal, financial, safety, or relationship decisions.

10.3 Required in-product acknowledgment for AI Spiritual Director. Before using the AI Spiritual Director or other high-reliance AI features, you must review and acknowledge an in-product disclosure explaining that the feature is AI-generated, non-human, not pastoral counseling or therapy, not a crisis service, and not a substitute for qualified human help. Your use of those features is conditioned on that acknowledgment.

10.4 Crisis and emergency resources.

If you are in crisis, considering self-harm, thinking about suicide, at risk of harming another person, experiencing abuse, or facing a medical or safety emergency, stop using the Service for that issue and seek human help immediately.

  • United States: call or text 988 (Suicide & Crisis Lifeline)
  • United States: text HOME to 741741 (Crisis Text Line)
  • Immediate danger: call 911, or go to the nearest emergency department
  • Outside the United States: contact your local emergency number or a recognized crisis line

The Service may display crisis resources when certain inputs are detected, but those detections are not guaranteed. The Service is not designed to assess risk, diagnose conditions, contact emergency services, or provide crisis intervention.

10.5 Warranty disclaimer. To the fullest extent permitted by law, the Service and all outputs are provided "as is" and "as available," without warranties of any kind, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, accuracy, theological soundness, or suitability for any purpose.

11. Limitation of Liability

To the fullest extent permitted by law, Wayward Found and its members, managers, officers, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages; lost profits; lost revenue; lost data; loss of goodwill; emotional distress damages; or the cost of substitute services arising out of or relating to the Service or these Terms, even if advised of the possibility of such damages.

To the fullest extent permitted by law, Wayward Found's total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid to Wayward Found through Stripe or another authorized payment platform for the Service during the twelve months before the event giving rise to the claim, or (b) $100.

Nothing in these Terms excludes or limits liability to the extent it cannot be excluded or limited under applicable law, including liability for fraud, intentional misconduct, or personal injury caused by conduct for which liability may not legally be limited. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

12. User Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Wayward Found and its members, managers, officers, employees, contractors, service providers, and licensors from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your User Content, your misuse of the Service, your violation of these Terms, your violation of law, or your violation of third-party rights, except to the extent caused by Wayward Found's gross negligence, willful misconduct, or violation of law.

13. Suspension and Termination

We may suspend, restrict, or terminate your account or access to the Service if we reasonably believe that you violated these Terms, created legal or safety risk, misused the Service, shared credentials, infringed rights, attempted to bypass safety controls, submitted prohibited content, or used the Service in a way that could harm us, users, third parties, or the Service.

You may delete your account or cancel your subscription as described in the Service and the Refund Policy. Termination of your account ends your right to access the Service, but does not automatically delete all information we are required or permitted to retain under the Privacy Policy, law, security requirements, accounting rules, backup procedures, or dispute-resolution needs.

Sections that by their nature should survive termination will survive, including provisions relating to intellectual property, User Content licenses, AI disclaimers, warranty disclaimers, limitations of liability, indemnity, dispute resolution, and governing law.

14. Arbitration Agreement; Class-Action Waiver

14.1 Informal resolution first. Before filing a claim, you and Wayward Found agree to try to resolve the dispute informally. The party asserting a dispute must send written notice describing the dispute and requested relief. We will send notices to the email address associated with your account; you may send notices to support@waywardfound.com with the subject line "Legal Dispute Notice." If the dispute is not resolved within 30 days after notice, either party may proceed as permitted below.

14.2 Binding individual arbitration. Except for the claims listed in Section 14.4, you and Wayward Found agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, subscriptions, AI outputs, User Content, or your relationship with Wayward Found will be resolved by binding individual arbitration under the Federal Arbitration Act and administered by the American Arbitration Association under its Consumer Arbitration Rules, or by another nationally recognized arbitration provider if AAA is unavailable or refuses to administer the arbitration.

The arbitration may be conducted by documents, telephone, or video conference unless the arbitrator determines that an in-person hearing is required. If an in-person hearing is required, it will occur in the county of your residence or in Minnehaha County, South Dakota, unless the parties agree otherwise. The arbitrator may award the same individual remedies that a court could award, subject to these Terms.

14.3 Class, collective, and representative waiver. You and Wayward Found agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated, private-attorney-general, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any class, collective, consolidated, or representative proceeding, except to the extent this waiver is prohibited by applicable law.

14.4 Exceptions. Either party may bring an individual claim in small-claims court if it qualifies. Either party may seek temporary, preliminary, or permanent injunctive relief in court for intellectual-property misuse, unauthorized access, security incidents, confidentiality breaches, or misuse of the Service. Nothing in this Section waives a non-waivable right to seek public injunctive relief under applicable law; if a court determines that a claim for public injunctive relief cannot be arbitrated or waived, that claim will be severed and may proceed in court, while all arbitrable claims proceed in arbitration.

14.5 Opt-out. You may opt out of this arbitration agreement by emailing support@waywardfound.com within 30 days after you first accept these Terms, with the subject line "Arbitration Opt-Out" and your name, account email, and a clear statement that you opt out of arbitration. Opting out will not affect any other part of these Terms. We may maintain records of opt-out requests, including the requesting account email, date received, request text or subject line, date acknowledged, and the version of the Terms to which the opt-out relates.

15. Governing Law; Forum

These Terms are governed by the Federal Arbitration Act, applicable federal law, and the laws of the State of South Dakota, without regard to conflict-of-law rules, except that this choice of law will not deprive a consumer of mandatory protections of the law of the jurisdiction where the consumer resides if those protections cannot be waived by contract.

For claims not subject to arbitration or small-claims court, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in South Dakota, subject to any non-waivable consumer venue rights.

16. Changes to the Service or Terms

We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms, updating the "Last updated" date, emailing you, or providing in-product notice, as appropriate. Material changes to automatic-renewal terms, pricing, arbitration, User Content rights, AI disclaimers, or privacy-related terms will be handled in the timing and manner required by applicable law. If you do not agree to updated Terms, you must stop using the Service and cancel any subscription before the change takes effect.

17. Organizations, Churches, and Ministries

This Section 17 applies where a church, ministry, nonprofit, small group, or other organization (each, an "Organization") uses the Service to host a community space, run a submission campaign such as Stories of Grace, operate a prayer wall, publish content to its members, or receive administrative access. It applies in addition to the rest of these Terms, which continue to govern every individual account.

17.1 Authority to act for an Organization. If you request, accept, or exercise an administrative or leadership role for an Organization, you represent and warrant that you are authorized by that Organization to do so, that the information you provide about the Organization is accurate, and that you will promptly notify us if your authority ends. You may not claim to represent, act on behalf of, or be affiliated with any Organization without its authorization.

17.2 How Organizations are added. Organizations and administrative roles are established by us, not by self-service enrollment. We may verify an Organization and the authority of the people who claim to represent it before, during, or after granting access, and we may require documentation. Listing, verification, or the grant of a role is not an endorsement of an Organization, its leadership, or its teaching.

17.3 Organization responsibilities. An Organization and its authorized personnel agree to keep Organization information accurate; to use member content, reviewer access, and submitted testimonies only for the purposes disclosed to the person who submitted them; to handle submissions and personal information with care and in compliance with applicable law; to obtain any consents their own activities require; and not to present Wayward Found as the source of pastoral counsel, doctrine, or professional advice. Member content belongs to the member who submitted it, not to the Organization, and an Organization's access to it ends when its access to the Service ends.

17.4 Suspension or removal of an Organization. We may suspend, restrict, unpublish, or terminate an Organization's access, hub, branding, custom domain or subdomain, access codes, campaigns, or published content, in whole or in part, if we reasonably believe that the Organization or a person acting for it violated these Terms, misrepresented its identity or authority, created legal or safety risk, misused member content or personal information, or acted in a way that could harm members, the public, Wayward Found, or the Service. Where practical and lawful, we will give notice and a reasonable opportunity to respond, but we may act first where delay would create risk. Suspending an Organization does not by itself terminate the personal accounts of its members.

17.5 Discretion to decline or discontinue service. Participation in the Service is not an entitlement. In addition to any other right in these Terms, we may decline to provide, or may discontinue providing, the Service or any part of it to any person or Organization at our discretion, including where we determine that the relationship is not a fit for the mission, character, or safe operation of the Service. We will not exercise this discretion on a basis prohibited by applicable law. Where a paid subscription is affected, the Refund Policy and applicable law govern any amounts already paid.

17.6 Review. If your account or your Organization's access is suspended, restricted, or terminated, you may ask us to review the decision by contacting support@waywardfound.com with the subject line "Access Review." We will consider timely requests in good faith. Review is not available where prohibited by law or where the underlying conduct involves safety, exploitation of minors, or unlawful activity.

18. Contact

Questions about these Terms may be sent to support@waywardfound.com.
